FREE AT LAST: CHARGES DISMISSED AGAINST MICHAEL CLANCY, 'WRONG MAN' IN BRONX MURDER CASE.
On February 23, 2009, in Bronx Supreme Court, the Bronx DA's office moved to dismiss all charges against Michael Clancy, 34, who had spent eleven years in prison for the March 30, 1997 murder of John Buono, committed in the Bronx. The motion was granted by the Hon. William Mogelescu. (Click here to read The New York Times story and click here to read the Daily News story.)
Clancy's conviction was overturned on April 1, 2008 by the Hon. Denis Boyle, the judge who presided at Clancy's original trial, based upon new evidence supplied by a federal informant, that another man, Andrew Dejesus, had committed the crime. (Click here to read the decision.)
Following an investigation by the Bronx DA's office, the District Attorney today moved to dismiss all charges against Clancy, based upon evidence that "another man, not Mr. Clancy," had killed John Buono.
"Michael Clancy's road to exoneration has been long and painful," his attorney Ronald L. Kuby said, "but Michael never gave up hope." "For every wrongful conviction, there is an innocent man in prison and a guilty man walking the streets," Kuby added.
